Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Waitlio at waitlio.co.uk (the “Service”). Waitlio is a product of MJM Dev, a sole trader based in the United Kingdom (“we”, “us”, “our”).
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. About the Service
Waitlio lets you create public waitlist pages with referral mechanics, track signups and positions, manage plan limits, and (on paid plans) export subscriber data as CSV. Features available to you depend on your plan.
We may change, suspend, or discontinue parts of the Service with reasonable notice where practicable. We may also update these Terms; continued use after changes take effect means you accept the updated Terms.
2. Eligibility and accounts
- You must be at least 18 years old to register.
- You must provide accurate registration information and keep your password secure.
- You are responsible for activity under your account. Notify us promptly of any unauthorised use.
- If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.
3. Plans, fees, and billing
- Free and paid plans are described on our pricing page. Limits (campaigns, subscribers, CSV export) apply as stated for your plan.
- Paid subscriptions are billed in advance through Stripe on a recurring basis (typically monthly) until cancelled.
- Prices may be shown exclusive of VAT. If UK VAT applies, it will be added as required by law and shown at checkout where applicable.
- You authorise Stripe to charge your payment method for fees due. Failed payments may result in suspension or downgrade of paid features.
- You can manage or cancel your subscription via the billing portal in your dashboard (or as otherwise provided). Cancellation typically takes effect at the end of the current billing period unless stated otherwise.
- Except where required by law (including your rights under the Consumer Rights Act 2015 if you are a consumer), fees are non-refundable once a billing period has started.
4. Your content and waitlist data
You retain ownership of content you submit (campaign copy, branding choices) and of subscriber data collected through your campaigns (“Customer Data”).
You grant us a limited licence to host, process, and display Customer Data solely to provide and secure the Service.
You are responsible for:
- Having a lawful basis to collect and use subscriber emails
- Providing any required privacy notice to people who join your waitlist
- Complying with UK GDPR, PECR, and marketing rules if you email subscribers outside Waitlio
- Not uploading unlawful, infringing, or harmful content
5. Acceptable use
You must not:
- Use the Service for unlawful, fraudulent, or deceptive purposes
- Attempt to bypass plan limits, security, or rate limits
- Scrape, reverse engineer, or disrupt the Service
- Collect personal data without a lawful basis, or spam people using referral or export features
- Upload malware or content that violates others' intellectual property or privacy rights
We may suspend or terminate accounts that breach these Terms or create risk for the Service or other users.
6. Intellectual property
The Service, including software, design, and branding (other than your Customer Data), is owned by us or our licensors. You may not copy, modify, or create derivative works except as allowed by these Terms or applicable law.
“Powered by Waitlio” branding may appear on public waitlist pages. Removing it is not offered unless we expressly enable that feature for your plan.
7. Third-party services
Payments are processed by Stripe. Your use of Stripe is subject to Stripe's terms. We are not responsible for outages or acts of third-party providers beyond our reasonable control, though we will take reasonable steps to keep the Service available.
8. Disclaimer
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or any particular number of waitlist signups.
Nothing in these Terms excludes or limits liability that cannot be excluded under English law, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or your statutory rights as a consumer.
9. Limitation of liability
Subject to section 8, our total liability arising out of or in connection with the Service or these Terms in any 12-month period is limited to the fees you paid us for the Service in that period (or £100 if you are on a free plan).
We are not liable for indirect, incidental, special, consequential, or punitive losses, or loss of profits, revenue, data, or goodwill, whether in contract, tort (including negligence), or otherwise, except where such exclusion is not permitted by law.
10. Consumer rights (UK)
If you are a consumer in the UK, you have rights under the Consumer Rights Act 2015 and related law that these Terms do not reduce. If you enter a distance contract for paid services, you may also have a 14-day cancellation right under the Consumer Contracts Regulations 2013, unless you request that we start the service during that period and acknowledge that you may lose the right to cancel once performance has begun.
11. Termination
You may stop using the Service and cancel paid subscriptions as described in your dashboard. We may suspend or terminate access for breach of these Terms, non-payment, or risk to the Service. On termination, your right to use the Service ends; sections that by nature should survive (including intellectual property, disclaimers, liability limits, and governing law) will continue.
To delete your account and associated personal data, go to Account settings and follow the email confirmation steps. Deletion cancels any active subscription and removes your campaigns and waitlist data. We handle requests in line with our Privacy Policy and UK GDPR.
12. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may bring proceedings in your local courts where mandatory consumer protection rules allow.
13. General
- If any provision is found unenforceable, the rest of the Terms remain in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- These Terms are the entire agreement between you and us regarding the Service.
